REGULATION AND RENTAL EQUIPMENT CONDITIONS
The use of the rented material is subject to the provisions of article 1803 ss of the Italian Civil Code.
TERMS & CONDITIONS
Wherever used herein, the term “equipment” shall include any equipment rented from Holimites Srl. Holimites Srl, its agents, servants, and employees shall not be responsible for personal injuries or property damage, loss or delay incurred by any person arising out of the act of negligence of any direct or supplemental carrier or other person rendering any of the services or products being offered in these rentals; not shall Holimites Srl be responsible for any injuries, death, damage, loss or delay in any means of transportation or by reasons of any event beyond the actual control of Holimites Srl, or of any agent or supplier, or due to force majeure. Customers follow any suggested itinerary at their own risk and agree not to hold Holimites Srl, its agents, servants and employees responsible for injury or death resulting from accidents. We strongly recommend the use of approved helmets whenever mounted on a bicycle. Helmets can be provided at extra cost. The bicycles provided for use are in satisfactory operating condition and participants agree to use them at their own risk or call deficiencies to the attention of a company representative. Instruction in the use, assembly and maintenance of bicycles will not be provided and participants affirm that they are competent and familiar with the use of a multi-speed bicycle. Using a bike assumes that the client possess the physical fitness and technical expertise required to use it; therefore, the client understand how to operate the rental bicycle and he/she is competent to operate it.
MAINTENANCE, TUNING AND RESPONSIBILITY
Although all our bikes are professionally serviced before dispatch, bicycles may need tuning or maintenance during the course of the rental period; such maintenance will be carried out at the renter's expense. Holimites Srl will cover the cost of damages due to equipment failures beyond the renters control; i.e. damage occurred during transport or worn parts. Any deficiencies must be communicated to Holimites Srl within 48 hours of receipt of the equipment. To be eligible for a refund on such parts and service, the client must provide Holimites Srl with a photo of the damaged or worn parts and an invoice for new parts or services. Holimites Srl is not responsible for: structural deficiencies such as damaged frames, bottom brackets, suspension and wheel hubs, gear tune ups / punctures / broken spokes / broken chains / broken derailleurs / wheel rim damage / torn saddles / damage beyond the control of Cycling Rentals. The client has to maintain the bike in a secure manner at all times and maintain its condition; if it loses operating efficiency during the period of use, he/she must immediately return the equipment to the place of rental and inform the staff. The client is not authorized to transport the bicycle by car unless he/she provides appropriate protective measures. The client responsible for any damage resulting from the unsafe transportation of the bike and such damages are not covered by any kind of insurance.
RESPONSIBILITY FOR DAMAGE OR LOSS
Customer agrees he/she will return the equipment in the same good condition as when received, ordinary wear and tear accepted, and to repair and replace lost or stolen, damaged or broken bicycles or parts or to reimburse Holimites Srl for said equipment. Therefore regardless of the party at fault, customer understands and agrees to be responsible for the theft or damage to said equipment. The client is liable and responsible for any damages and expenses of any nature relating to a stolen, lost or damaged bike and equipment during the period of use, as well as the cost to repair such damages or replace the bike. If the bike is lost or stolen, the client is responsible for its replacement cost. If it is stolen, the client must notify police of its theft.
Customer understands and agrees that any subleasing of rental equipment is prohibited and that any such sublease shall immediately cause termination and cancellation of this contract.
Customer shall assume liability for any and all damage or loss of and to personal property, accident / injury to other persons related to said rental equipment. The customer declare that he/she is either in possession of third-party insurance coverage, or he/she authorize Holimites Srl and/or the bike rental company to charge your credit card for any damages incurred during the rental period. We strongly recommend that our customers always carry a personal or travel insurance policy.
TERMINATION OF AGREEMENT
Customer agrees that Holimites Srl has the right to terminate this agreement at any time and retake possession of said equipment and for said purpose Holimites Srl may enter upon the premises of the customer without becoming liable for trespass.
We may require a damage deposit in the form of credit card charge plus the driver’s license / photo ID of one member of the party. Any deposit given by the customer shall be applied to and guarantee the faithful performance of all the provisions of this agreement and all repairs necessary to said equipment. If any action is brought to enforce any of the terms of conditions of this agreement, or to recover any sums due to hereunder, customer agrees to pay all legal fees, court costs, or other expenses.
LATE RETURN FEE
An additional day’s rental fee will be charged for each day customer keeps equipment after the return date specified on this contract. All equipment must be returned directly to Holimites Srl or wherever agreed. The bike rental is included from 09:00 a.m. on the day of pickup until 4:00 p.m. on the day of drop-off.
All cancellations without exception, must be in writing and submitted to Holimites at email@example.com
In case of cancellation by the customer, a cancellation fee will apply.
The fee is calculated as follows:
- Cancellation up to 5 days from the date of pickup:
▪ the amount of 25,00 Euro per bike will be retained
- Cancellation from the 04th day to the date before pickup:
▪ 80% of the amount will be retained
If a customer does not take over a booked bike for the period agreed upon, without any communication in advance, no reimbursement will be made so.
- Cancellation on the pickup date:
▪ 100 % of the payment will be retained
